REFUND POLICY

This Refund Policy explains how Chart Stalker (Pty) Ltd, trading as Plug 'n Play Trading Tech and operating the Aura Terminal platform ("we", "us", "our", "Aura"), handles refund requests for subscription fees and other charges. It should be read together with our Terms of Service and Privacy Policy. Chart Stalker (Pty) Ltd is an authorised Juristic Representative (FSP 51478) of 1st Fintech Capital, registered with the Financial Sector Conduct Authority (FSCA).

1. General Principles and CPA / ECTA Compliance

This policy operates in good faith and is governed by the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). The following statutory rights apply to every paid Aura Terminal subscription.

1.1 ECTA Cooling-Off Period

In accordance with Section 44 of ECTA, you have the right to cancel a transaction concluded electronically and obtain a full refund within seven (7) days of the date of purchase, without reason or penalty. This cooling-off right is forfeited where the service has been substantially used during the cooling-off period (for example, where you have actively used the scanner, signals, chart, or any other paid feature in a way that is more than incidental).

1.2 Fixed-Term Agreement Cancellation

In accordance with Section 14 of the CPA, you may cancel a fixed-term subscription (such as an annual plan) at any time by giving twenty (20) business days' written notice to support@plugnplaytradingtech.com. Where you cancel before the end of the fixed term, we may charge a reasonable cancellation penalty, calculated with reference to the discount you received for committing to a fixed term, the value of the service already consumed, and the period remaining. Any penalty applied will be itemised in writing.

1.3 Implied Warranty of Quality

In accordance with Sections 55 and 56 of the CPA, Aura Terminal is warranted to be reasonably suitable for the purposes for which it is generally intended, of good quality, in good working order, and free of defects. If the service is found to be defective during the implied warranty period, you are entitled to a full refund, a repair, or a replacement, at your election.

2. POPIA and the Refund Process

Processing a refund request requires us to collect and process limited personal information. We do so in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA").

When you submit a refund request we collect only the information necessary to verify your identity, locate your transaction, and process the refund:

In line with the POPIA principle of minimality, we collect only the minimum information needed to action your request. Banking details, where supplied, are used solely to process the refund and are not retained beyond what is required. Refund-related records are retained for five (5) years in compliance with South African financial legislation, including the Financial Intelligence Centre Act 38 of 2001 (FICA) and South African Revenue Service (SARS) record-keeping requirements.

2.3 Security of Information

Refund requests are handled exclusively by authorised personnel of Chart Stalker (Pty) Ltd. All communications and supporting documents are transmitted and stored over secured channels with appropriate technical and organisational safeguards in place, in accordance with Section 19 of POPIA.

4. Refund Payment Details

4.1 Refund Method

Approved refunds are paid by Electronic Funds Transfer (EFT) or by reversal to the original payment method. In accordance with the CPA, you have the right to elect a monetary refund where you are entitled to one, rather than a credit or replacement.

4.2 Refund Timeframe

Where a refund is approved, payment will be made within fifteen (15) business days of our receipt of your valid cancellation or refund notice (and, where applicable, of your supporting banking details).

4.3 Cancellation Penalties

Where a reasonable cancellation penalty applies (for example, on early termination of a fixed-term plan under Section 14 of the CPA), the penalty will be calculated in accordance with the regulations to the CPA, itemised in writing, and deducted from the refund amount before payment.
